2 The petitioner apprehends arrest in Complaint Case No 384 of 2019 registered for the offence punishable under Sections 341, 323, 498A, 379, 384, 504, 506/34 of Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act. 3 As per the prosecution case, the petitioner, who is husband of complainant, tortured, humiliated, assaulted and ousted her from the matrimonial home.
4 Learned counsel for the petitioner submits that the dispute has been settled and the petitioner has paid Rs 5 lacs to
Patna High Court CR. MISC. No.51073 of 2022(8) dt.17-08-2023 2/2 Opposite Party No 2 through bank draft pursuant to the order passed in Divorce Case No 23 of 2023 (Annexure A series). 5 Learned counsel for Opposite Party No 2 and learned APP do not dispute the fact.
6 Considering the submissions, in the event of arrest/surrender within a period of six weeks from today, the petitioner above named be enlarged on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Udakishunganj/Sessions Judge, Madhepura in Complaint Case No 384 of 2019 subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure.
