The petitioners apprehend their arrest in Goh P.S. Case No.63 of 2019 registered under Section 307 and other Sections of the Indian Penal Code.

The informant, Md. Basaruddin named seven persons including three petitioners and alleged that Md. Salim assaulted the informant with stick on his head causing bleeding and Md. Kaiser Ansari assaulted Abid Hussain Ansari, nephew of the informant.

The learned counsel for the petitioners submits that petitioners are co-sharers of the informant. Abid Hussain Ansari got one injury which is simple in nature. The informant,

Patna High Court CR. MISC. No.46693 of 2019(2) dt.29-07-2019 2/2 Basaruddin also got one lacerated wound on upper occipital head caused by hard and blunt object. There is no allegation of assault against Md. Hamid and Md. Salamudin Ansari @ Md. Salahudin Ansari, petitioner Nos.1 and 3.

Taking into consideration the facts aforesaid and the fact that there is no allegation against Md. Hamid and Md. Salamudin Ansari @ Md. Salahudin Ansari, petitioner Nos.1 and 3 and injury caused by Md. Salim is simple in nature, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, in the district of Aurangabad in connection with Goh P.S. Case No.63 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
