JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-11-2019 This writ application has been filed seeking quashing of an order dated 27.03.2019, whereby the petitioner has been put under suspension in contemplation of a departmental proceeding to be initiated against him. At the relevant point of time, the petitioner was working as Joint Manager (MMG/S-II), Thakurganj Branch, Purnea Region. It appears that departmental proceeding has been initiated after filing of the writ petition. I have heard the petitioner in person and learned counsel appearing on behalf of the Bank of Baroda. It has been submitted on behalf of the Bank that the disciplinary proceeding against the petitioner shall be concluded expeditiously, if the petitioner cooperates in the said proceeding by presenting himself before the Enquiry Officer as and when required. The petitioner, in person, submits that he shall not take unnecessary adjournment in the departmental enquiry and he shall cooperate in expeditious disposal of the same. On the basis of instructions, which learned counsel appearing on behalf of the Bank has received, it has been stated that the same shall be concluded within a period of 45 days from today.

Be that as it may, considering the facts and circumstances of the case, this writ application is disposed of with a direction to the disciplinary authority to ensure that the departmental proceeding against the petitioner is concluded within six weeks from today, failing which the impugned order of suspension shall lose its efficacy and shall stand revoked. This application stands disposed of.
