JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-04-2016 As prayed, the application is dismissed in so far as the Petitioner no. 2 Dharmendra Kumar Singh who was arrested during the pendency of the application.
Heard Mr. Kirshna Prasad Singh, the counsel for the petitioner and Ramchandra Singh, APP for the State. The only non-bailable section for which petitioner no. 1 has been accused of Section 353 IPC lodged by the SubRegistrar Aurangabad alleging that the accused(s) entered into the Registry Office and exerted pressure on him to register their sale deed first and also indulged in abusing and assaulting him. Patna High Court Cr.Misc. No.12987 of 2016 (2) dt.13-04-2016 2/2 of sale deeds/ documents were presented to be registered on the day, as from the following day the new MVR was implemented by the State of Bihar. The informant did not take up the matter promptly. The occurrence, if any, was not promptly reported to the Superintendent of Police or the Administration whose offices are situated nearby the registry. After one day a written report was submitted against the petitioner. The petitioner does not carry any criminal antecedents.
In the facts and circumstances of the case, let the petitioners above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in P.S. Case No. 38/2016 on condition that one of the bailors shall be his own/close family member. The petitioner shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
