Versus
The State of Bihar. .... .... Opposite Party ====================================================== Appearance :
For the Petitioner/s : Mr. Sanjeev Kumar, Advocate For the Opposite Party/s : Ms. Anita Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 19-08-2015 Heard learned counsel for the petitioner and learned APP for the State.
By filing the present application under Section 438 of the Code of Criminal Procedure, the petitioner seeks anticipatory bail in connection with Konch P.S. Case No. 2 of 2014 registered under Section 304-B read with 34 and 201 of the Indian Penal Code.
It is contended that the victim died due to accidental fire. She was immediately taken to the local hospital from where, she was referred to Anugrah Narayan Magadh Medical College, Gaya and, while on way to A.N.M.M.C., Gaya, she died.
Patna High Court Cr.Misc. No.50567 of 2014 (3) dt.19-08-2015 2 / 2 On the other hand, learned counsel for the State has vehemently opposed the prayer for bail. He has submitted that the informant has alleged that the victim was killed in her matrimonial house due to non-fulfilment of demand of dowry within one year of her marriage and in utter haste her dead body was disposed of. It is pointed out that there is no document to show that the victim was ever treated in any hospital. Regard being had to the serious nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected.
