2. The petitioner seeks bail in a case registered for the offence punishable under Sections 309(6) of the BNS, 2023 (394 of the IPC) and Section 27 of the Arms Act.
3. As per the prosecution case, FIR has been lodged against four unknown persons making allegation that they committed robbery in the shop of the informant of some gold, silver and cash and even resorted to firing causing injury to some persons.
4. Learned counsel for the petitioner submits that the present FIR was lodged against unknown on 30.01.2025 and on 01.11.2025 four persons were apprehended by the police on the
Patna High Court CR. MISC. No.51367 of 2025(4) dt.05-12-2025 2/3 charges of planning a loot for which a separate case being Shahajitpur P.S. Case No. 11 of 2025 was lodged, wherein confessional statement of the accused persons including the present petitioner was recorded and on the basis of such confessional statement, the petitioner and other accused persons were also remanded in the present case. So far as recovery is concerned some general recovery has been shown from different accused persons including the present petitioner. However, no TIP of the petitioner has been conducted till date. Further, it has been submitted that other similarly situated co-accused persons Ravish Kumar and Vinod Kumar who were arrested alongwith petitioner in Sahajitpur P.S. Case No.
10 of 2025 have already been granted the privilege of bail by a co-ordinate bench of this Court vide order dated 20.08.2025 passed in Criminal Miscellaneous No. 42084 of 2025 and its analogous case. The petitioner is in custody since 18.02.2025. The charges have already been framed in this case, however, no witness has been examined in this case till date.
5.Taking into consideration the facts and circumstances and also considering the fact that the name of the petitioner has surfaced in this case on account of his confessional statement before the police which has no

No.51367 of 2025(4) dt.05-12-2025 3/3 evidentiary value coupled with the fact that similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court and charges have already been framed in this case and further considering that petitioner has remained in custody since 18.02.2025, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Saran in connection with Sessions Trial No. 372 of 2025 arising out of Sahajitpur P.S. Case No. 10 of 2025, subject to the following conditions:- (i) one of the bailors of the petitioner shall be his family member. (ii) the petitioner shall co-operate in the trial and would appear on each and every date and in case of non-appearance on two consecutive dates without sufficient cause, his bail bond shall stand cancelled.
