JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 47(A) of the Excise Act.
The prosecution case is that the Sub-Inspector, Excise raided the place and seized 20 liters of illicit liquor and also seized 200 kilogram of Jawa Mahua and the petitioner fled away from there.
It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the recovered items belonged to the petitioner. Statement has been made in paragraph3 of the petition that the petitioner has got no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail let the learned court below consider the
Patna High Court Cr.Misc. No.12745 of 2016 (2) dt.28-03-2016 2/2 prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Excise Case No. 89 of 2015, pending in the court of Sri Sampat Prakash, the learned Judicial Magistrate 1st Class, Gaya.
