2. The petitioner seeks regular bail in connection with Phulparas P.S. Case No. 299 of 2023 dated 30.05.2023, lodged under Sections 302, 120 (B), 34 of the Indian Penal Code read with section 27 of the Arms Act.

3. As per the prosecution case, FIR has been lodged against 3 named (including the present petitioner) and 3 unknown accused persons against whom there is an allegation that they have killed the informant's husband.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the criminal antecedent of the petitioner is not clean as there are two criminal cases pending against him in which in

Patna High Court CR. MISC. No.55630 of 2024(3) dt.31-08-2024 2/2 both the cases, he is on bail. Counsel further submits that the petitioner is in custody since 04.09.2023. Counsel also submits that other co-accused person has been granted bail by this Court vide order dated 22.02.2024 passed in Cr. Misc. No.11195 of 2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that it is the petitioner who has slapped the informant's husband and taken him outside from the wedding place and immediately thereafter, informant's husband was killed.

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner at present.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Phulparas P.S. Case No. 299 of 2023, pending before the learned A.C.J.M.-II, Jhanjharpur, Madhubani is hereby rejected.
