The petitioner prays for appropriate writ in the nature of mandamus commanding the authorities of the Nagar Panchayat, Ghoghardiha to make payment of the amount admissible to the petitioner for construction of toilets in ward No.1 of the Nagar Panchayat in question in the district of Madhubani. According to the petitioner as per the agreement entered in between the parties he was to construct toilets in Ward No.1 and which has since been completed and whereafter the petitioner has raised his bill but neither the Executive Officer of the Nagar Panchayat, Ghoghardiha nor the Junior Engineer concerned have discharged their obligation to carry out the measurements or pass any orders

Patna High Court CWJC No.7946 of 2016 (3) dt.13-05-2016 2/2 with regard to payment of the pending in the bills. Having heard learned counsel for the parties and considering the nature of grievance so raised, I deem it fit and proper to dispose of the writ petition with the direction to the Executive Officer, Nagar Panchayat, Ghoghardiha District Madhubani as well as the Junior Engineer, Nagar Panchayat, Ghoghardiha District Madhubani respondents 4 and 5 herein to consider the grievance of the petitioner and dispose of the same in accordance with law but only after opportunity of hearing to the petitioner within a period of three months from the date of receipt/production of a copy of this order.

It goes without saying that whatsoever amount that is found admissible to the petitioner should be paid to him within the period stipulated and any amount not found admissible be disposed of by a speaking order.
