No one appears on behalf of the State.
The petitioner apprehends his arrest in Gurua P.S. Case No. 04 of 2016 registered under sections 326 & 506 IPC, section 3⁄4 of the Dyne Act and sections 3(i) (x) (xv) of the SC/ST (Prevention of Atrocities) Act (for short 'the Act'). On going through the FIR, it appears that an active role is assigned to the petitioner. It is stated that the provisions of the SC/ST Act shall not be applicable insofar as the petitioner is concerned. He has no criminal antecedent.
Although the allegation may be said to be trivial in nature as no serious harm/injury has been caused to the informant, but considering the bar provided under section 18 of the Act, this Court is not inclined to grant anticipatory bail to the petitioner
Patna High Court Cr.Misc. No.12758 of 2016 (2) dt.06-04-2016 2/2 leaving him to surrender and seek regular bail. Needless to observe if the petitioner surrenders and prays for bail, the same shall be considered and disposed of on its own merit unprejudiced by the present order.
The application stands disposed of.
