Petitioner and Jyoti Singh are named accused of Agiaon (G) P.S. Case No. 64 of 2015 registered under Sections 304, 120(B) and 34 of the Indian Penal Code.
The informant has alleged that the petitioner and Jyoti Singh called his brother and took him to connect the electric wire from the Pole. His brother scaled the electric pole to connect the wire when the electricity resumed and he got electrocuted. Immediately, these two persons carried him to the hospital where he died.
Contention of the petitioner is that there is absolutely no motive against the petitioner to do away the life of the deceased who was an electrician by profession and was requested to connect the electric wire. Considering the above, co-accused Jyoti Singh
Patna High Court Cr.Misc. No.14258 of 2016 (3) dt.26-05-2016 has been granted anticipatory bail vide order dated 18.02.2016 passed in Cr. Misc. 3653 of 2016. The case of the petitioner is identical.
Considering the facts and circumstances of the case, in the event of arrest or surrender in the Court below within four weeks, the petitioner abovenamed is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in Agiaon (G) P.S. Case No. 64 of 2015 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions:
(i) One of the bailers shall be the own/close family members of the petitioner.
(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
