JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-04-2021 Heard Mr. Ranjan Kumar Jha, learned counsel for the petitioner and Ms. Renu Kumari, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Excise P.S. Case No. 58 of 2020 registered for the offences punishable under Section(s) 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The allegation as per the prosecution report is that the Excise Official raided the house of Raju Chaudhary and Mangal Chaudhary and from a room situated at the ground floor, a total quantity of 250.685 litres of illicit liquor was recovered and the petitioner along with Renu Chaudhary was arrested by the Police.

No.7981 of 2021(2) dt.17-04-2021 2/3 Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and the house in question from where the illicit liquor was recovered belongs to the joint family and other family members and co-sharer are also residing there. Learned counsel further submits that the petitioner has got no criminal antecedent and co-accused Renu Devi @ Renu Chaudhary has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. 3386 of 2021. Learned counsel next submits that the petitioner is in custody since 14.6.2020 and the prosecution/investigation report has already been submitted in the matter.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that similarly situated co-accused person has been granted bail by a co-ordinate Bench of this Court and petitioner is in custody since 14.6.2020, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge, Excise, Bhagalpur, in connection with Excise P.S. Case No. 58

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
