2. The petitioner is in judicial custody in connection with Nathnagar (Madusudanpur) P.S. Case No. 67 of 2024 for the offences punishable under sections 302/201 of the Indian Penal Code and section 27 of the Arms Act, lodged on 27.01.2024 by the informant, Nitish Kumar.

3. As per the prosecution story, the informant alleged that his maternal nephew, Prince Kumar went out and later information came that both Prince Kumar and Shekhar Kumar have been shot at. They rushed to the place, the injured were taken to the hospital but as per the subsequent information, both succumbed to the injuries. This led to the FIR.

4. Learned counsel for the petitioner submits that save and except the confession statement of the accused persons

He, however, accepts that he has a number of criminal cases against him inasmuch as he has been named as an accused in sixteen cases, mostly related to Nathnagar PS.

Learned APP, on the other hand, has taken this Court to the different paragraphs of the case diary to submit that Rupesh and this petitioner used to extort the businessmen of the railway platform of Nathnagar railway station and in that course, both Rupesh and this petitioner opened fire which hit the two deceased. They tried to escape but the police and the locals apprehended them along with the fire-arms.

6. Considering the facts that have emerged coupled with the fact that he has criminal antecedent inasmuch as is an accused in almost sixteen cases and most of them are related to Nathnagar PS, this Court does not deem it fit and proper to extend the privilege of bail to the petitioner.

7. Accordingly, the bail application stands rejected. (Rajiv Roy, J) perwez U T
