Petitioner seeks bail in a case registered for the offences punishable under Sections 417, 406, 384, 376 of the Indian Penal Code.

According to F.I.R., the petitioner had taken loan of Rs.70,000/- (Rupees Seventy Thousand) and subsequently of Rs.40,000/- (Rupees Forty Thousand) from the informant. When the informant demanded refund of the same, the petitioner called her at the referred place and ravished her on 12.04.2018. Thereafter, the petitioner again demanded Rs.50,000/- (Rupees Fifty Thousand) from the informant and threatened that petitioner is in possession of some objectionable and adulterous photograph

Patna High Court Cr.Misc. No.36051 of 2018 (2) dt.28-06-2018 2/2 of the informant, which he would make public. Submission is that there is no chit of paper of advancement of alleged money. At worst this one may be a case of adultery, which is a bailable offence.

Learned counsel for the informant opposed the prayer for bail.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khaira Police Station Case No.173 of 2018, subject to the condition that both the bailors shall be resident of within the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
