ANJANA PRAKASH ORAL JUDGMENT Date: 16-02-2015 The Petitioners, who are distant relatives, seek quashing of the First Information Report of Lakhisarai P.S. case No.246 of 2004. A Supplementary Affidavit has been filed stating therein that the investigation is still pending.
Since the investigation should be rarely interfered with, I am not inclined to interfere in the matter.
The application is disposed of with a direction to the Investigating Officer to conclude the investigation positively within a period of one month from the date of receipt of this order noting the relationship of the Petitioners with the rest of the accused persons and the Informant, and close the investigation as regards them and proceed
Patna High Court Cr.Misc. No.44866 of 2011 dt.16-02-2015 2/2 in accordance with law as laid down in the case of Arnesh Kumar versus State of Bihar and another reported in 2014(3) PLJR 314 SC. Let this order be communicated to the Superintendent of Police, Lakhisarai through FAX at the cost of the Petitioner for its onward transmission to the Investigating Officer in connection with Lakhisarai P.S. case No.246 of 2004 pending in the court of Chief Judicial Magistrate, Lakhisarai.
