Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that petitioner is brother-in-law(Dewar) of the
Patna High Court CR. MISC. No.7181 of 2021(2) dt.06-12-2021 2/2 deceased and the thrust of accusation is against the husband of the deceased. The petitioner works outside State and at the time of occurrence, he was not present in the house. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Patahi P.S. Case No. 87 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
