====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-01-2024 The present writ petition has been filed seeking the following relief:- "1. For issuance of an appropriate writ/ writs, order / orders or direction/directions to the respondents to appoint the petitioner on the post of Peon on the compassionate ground in place of Late Paraniya Devi who died during duty on the post of Peon due to Covid-19 infection. Late Paraniya Devi was working as Peon before the Hon'ble Court she died on 23.04.2021.

The petitioner was not appointed on the post of Peon under compassionate ground because the petitioner is not unmarried daughter. Hence the

Patna High Court CWJC No.11278 of 2023(2) dt.02-01-2024 2/2 writ petition."

At the outset, the learned counsels appearing for the Respondents have jointly submitted that that the scheme for compassionate employment does not postulate providing appointment on compassionate ground to a married daughter of the deceased employee.

In view of the aforesaid, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the scheme itself. Liberty, so sought, is granted. 4.

Accordingly, the present writ petition stands disposed off as not pressed.
