JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2018 Petitioners apprehend their arrest in connection with Mahua P.S.Case No. 377 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 448, 354, 436, 380, 427 and 504 of the Indian Penal Code.

Allegation against the petitioners and several other accused persons is that they have entered inside the house of the informant and looted away articles and ornaments. Submission of learned counsel for the petitioners is that reason behind the occurrence is that one person was killed due to

Patna High Court Cr.Misc. No.31551 of 2018 (3) dt.29-06-2018 2/2 love affairs and for that the occurrence took place and petitioners have falsely been implicated in this case and there is no specific allegation against any of the petitioners.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S.Case No. 377 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
