The petitioner seeks bail in anticipation of his arrest in connection with Sangrampur P.S. Case No. 184 of 2017 dated 24.12.2017 instituted for the offences under Sections 379 and 411 of the Indian Penal Code and 4/40 B.M.M.C. Rule, 1972.

Learned counsel for the petitioner submits that the petitioner is the owner of the vehicle, which is alleged to have been used for the purposes of illegal mining of sand, for which there was a prohibitory order. It is further submitted that no valid document was produced by the Driver who fled away and, therefore, the petitioner being the owner of the vehicle has been roped in this case.

Patna High Court Cr.Misc. No.32822 of 2018(2) dt.29-06-2018 2/2 Another co-accused viz. Ajit Kumar @ Ajit Yadav has been granted bail by order dated 10.04.2018 passed in Cr. Misc. No. 16641 of 2018.

Considering the entire facts and circumstance of the case and that the petitioner had no knowledge that the sand was being transported in his vehicle, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Munger in connection with Sangrampur P.S. Case No. 184 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
