The petitioner voluntarily resigned from the post of Constable on 06.07.1979. Thereafter the petitioner filed C.W.J.C No. 2777 of 2006, which was rightly dismissed by the writ court vide order dated 16.12.2013.

We also see no error in the order of the learned writ court warranting reconsideration merely because the petitioner at that point of time submitted his resignation under mental illness and now

Patna High Court LPA No.31 of 2015 dt.12-05-2017 2/2 he cannot be permitted to withdraw his resignation after a long period of nearly 26 years. The petitioner being an employee of police department cannot be now allowed any indulgence. This appeal stands dismissed.
