Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-08-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Muffasil P.S. Case No. 181/2019, instituted for offence under Section(s) 420, 467, 468, 471/34 of the Indian Penal Code read with Section 66 of IT Act. It is alleged in the written report that on the date of occurrence petitioner along with three young boys entered into S.B.I. ATM situated in front of Mehta Petrol Pump. They tried to run away seeing the police party but on chase three persons including petitioner were apprehended by the police. It is alleged that one scanner, four ATM Cards with magnetic strips and a black colour plain ATM Card were recovered from possession of petitioner.

Learned counsel for petitioner has submitted that

Patna High Court CR. MISC. No.47264 of 2019(2) dt.05-08-2019 2/2 there is no specific allegation against this petitioner that he was carrying any illegal thing for withdrawal of money from the ATM and committed fraud.

Petitioner is in custody since 08.05.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Muffasil P.S. Case No. 181/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
