On account of kidnapping of a minor girl aged about 15 years namely Manju Kumari by the petitioner Chandan Kumar and Ravi Kumar, which was informed by Manish Kumar, younger brother of Manju Kumari, over which, informant Manoj Kumar, father of victim had filed written report. Victim has been recovered and her statement under Section 164 Cr.P.C. has been recorded (Annexure-2) wherefrom it is apparent that she has castigated against Ravi and his father Rajesh, who after confining her, having been raped at the end of Ravi.

On account of absence of petitioner's presence in the statement of the victim, petitioner Chandan Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten

No.47816 of 2014 (02) dt.16-04-2015 thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Tekari P. S. Case no.193 of 2014, within four weeks in event of his arrest/ surrender in terms of condition so enumerated under Section 438(2) Cr.P.C.
