JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Rail Samastipur P.S. Case No. 51 of 2018 (G.R. No. 341/2018) for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in custody since 10.04.2018 in connection with seizure of 14.25 litres foreign liquor. Learned counsel submits that the petitioner was traveling in the train and the liquor was lying in the bogie and it was seized by the Railway Police from the bogie and not from the conscious possession of the petitioner.

No.37178 of 2018 (2) dt.28-06-2018 2/2 Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge-cum-Special Judge, Excise Act, Samastipur in connection with Rail Samastipur P.S. Case No. 51 of 2018 (G.R. No. 341/2018).
