JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 435, 436, 427, 147, 149, 504, 341 and 323 of the Indian Penal Code. Prosecution case is that in retaliation of the murder of Satyawant Patel, thirteen F.I.R. named accused persons including the petitioner entered into the house of the informant on 02.02.2016 at 7.40 A.M. in the morning made assault to the informant and put the house on fire as a result house of articles like cooler, T.V. and other articles got burnt. It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.12484 of 2016 (2) dt.16-03-2016 2/3 brother of the petitioner no. 1, Bullu Singh, namely Satyawant Patel, was killed on 01.02.2016, leading to registration of Bhabua P.S. Case No. 52 of 2016 levelling accusation under Section 304/34 of the Indian Penal Code & Section 27 of the Arms Act, against the sons of present informant, namely, Jasimuddin Ansari & Badaru Mian. Hence as a reataliatory measure the present case has been lodged. The police also registered two cases for the same incident being Bhabua P.S. Case No. 54 and 55 of 2016 leveling accusation under Sections 147, 149, 353, 427, 435, 323, 504 and 295 of the Indian Penal Code and under Section 147, 148, 149, 323, 332, 333, 353, 427 and 504 of the Indian Penal Code respectively, wherein, the petitioner no. 1 was made accused in Bhabua P.S. Case No.
55 of 2016 and petitioner no. 2 and 3, were made accused in Bhabua P.S. Case No. 54 of 2016. Considering the above facts, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of 12 weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs.
