JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-02-2022 Heard the learned counsel for the petitioners as well as the learned counsel for the informant through video conferencing.
The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month.
Patna High Court CR. MISC. No.7188 of 2021(4) dt.08-02-2022 2/3 The petitioners apprehend their arrest in connection with Makhdumpur P.S. Case No. 174 of 2020 registered for offence punishable under sections 147, 148, 149, 341, 323, 307, 379, 452, 504, 506 of the Indian Penal Code.
The learned counsel for the petitioners has submitted that there is case and counter case and both the parties have sustained injuries. He has further submitted that prior to filing of the present case, petitioner no. 2 Mantu Yadav @ Halendra Kumar has lodged Makhdumpur P.S. Case No. 173 of 2020 against the informant side. He has also submitted that all the injuries found on the body of the injured person are simple in nature. The supplementary injury report has also been received, which shows that the injuries sustained by him is simple in nature.
Considering the above mentioned facts and circumstances, the petitioners above named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 174 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.
