====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 19-08-2023 Heard learned Counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners are apprehending their arrest in connection with Jagdishpur (Goradih) P.S. Case No.430 of 2022 dated 14.09.2022, lodged under Sections 304(B)/120(B) of the Indian Penal Code.
3. As per prosecution case, the F.I.R. has been lodged against three named accused persons. It has been alleged in the F.I.R. that marriage of informant's sister was solemnized with one Mr. Angad Kumar Manjhi against whom there is an allegation to kill his wife and in the said case the victim's mother-in-law, father-in-law and husband all were made accused.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.52673 of 2023(3) dt.19-08-2023 2/2 petitioners are mother-in-law and father-in-law of the victim, husband of victim is already in custody. He further submits that the allegation in the F.I.R. against them is general and omnibus and there is nothing specific. He also submits that antecedents of petitioners are clean. Learned counsel further submits that the petitioners were living separately with the victim and her husband few days after marriage.
5. Learned A.P.P. for the State opposes the prayer for bail but submits that in the pleading it has come that husband of the deceased wife is already in the custody.
6. In the present facts and circumstances, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, in connection with Jagdishpur (Goradih) P. S. Case No.430 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
