JUSTICE ASHUTOSH KUMAR ORAL ORDER 31-08-2021 Heard Mr. Vijay Kumar, learned advocate for the petitioner and Mr. Arif Daula Siddique, learned counsel for the Opposite Party No. 2. The State is represented by Mr. Gauri Shankar Gupta, learned APP. The petitioner seeks bail in anticipation of his arrest in connection with Chapra Town P. S. Case No. 41 of 2016, dated 23.01.2016, instituted for the offences under Sections 323, 324, 498(A), 504 and 384 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

The petitioner is the husband of Opposite Party

The matter was sent to the Patna High Court Mediation and Conciliation Centre for the needful. But according to the report of the Mediator, the mediation proceedings have failed.

Under the aforesaid circumstances and taking into account the allegation against him, this Court is not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, that shall be considered on its own merits, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.
