The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 302/120(B)/34/364 of the Indian Penal Code.
Diary in this case was called for earlier which has since been received.
Learned counsel for the petitioner submits that save and except a bald allegation that the petitioner was seen coming out from the place of occurrence, there is no further material in the case diary to support the allegation against the petitioner. It is further submitted that the main accused person, namely, Awadhesh Sharma and Prampravesh Sharma have already been
Patna High Court Cr.Misc. No.13495 of 2016 (3) dt.17-05-2016 P2/2 taken into custody.
Considering the aforementioned circumstances and also that save and except the allegation, there is no further material in the case diary to implicate this petitioner, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 786/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
