JUSTICE RAVI RANJAN ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sultanganj P.S. Case No. 141 of 2010 registered for the offence under Section-307 & other minor sections of the Indian Penal Code.
It is contended on behalf of the petitioner, who claims having clean antecedent, that falsity of accusation of assault by knife would be apparent from the injury report of the informant according to which a simple injury of lacerated wound is there, which is skin deep and has been caused by hard and blunt substances, wherein allegation is that the petitioner had assaulted the informant by knife causing sharp cut injury. Petitioner claims
Patna High Court Cr.Misc. No.17687 of 2016 (3) dt.25-05-2016 2/2 to be nephew (Bhagina) of husband of the informant and all of them are having common courtyard.
Having regard to the facts and circumstances of the case as well as submission of the parties, the petitioner named above, in the event of his arrest or surrender in the court below within four weeks shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sultanganj P.S. Case No. 141 of 2010 to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, Patna subject to conditions as laid down u/S 438(2) of the Cr. P.C.
