The petitioner seeks bail in connection with Bagaha P.S. Case No. 472 of 2011, registered under Sections 147, 148, 149, 341, 323, 302 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was refused on four times earlier lastly on 26.04.2017 passed in Criminal Miscellaneous No. 8736 of 2017 with direction to the learned court below to take all effective steps to conclude the trial of the petitioner within one year. The petitioner is in custody since 17.06.2013, but the trial of the petitioner has not been concluded as yet and the record is running for prosecution evidence.

Patna High Court Cr.Misc. No.35151 of 2018(3) dt.25-07-2018 2/2 A report has been received from the Court of Addl. Sessions Judge-I, Bagaha, West Champaran, vide letter No. 421, dated 18.07.2018, which disclosed that out of nine prosecution witnesses only two witnesses, namely, Sujit Rai and Sulekha Devi have been examined.

Having regard to the facts and the circumstances of the case and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Addl. Sessions Judge, Bagha, West Champaran in connection with Sessions Trial No. 513 of 2014, arising out of Bagaha P.S. Case No. 472 of 2011. (Rajendra Kumar Mishra, J) manish/- U T
