JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.
It is submitted by learned counsel for the petitioner that the issue has been reconciled between the parties and the informant is residing with the petitioner as wife. Same thing surfaced during investigation also.
Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for six
Patna High Court Cr.Misc. No.48047 of 2014 (2) dt.10-02-2015 months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Barauni (Refinery) P.S. Case No. 10 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The learned court below will issue notice to the informant and if she admits that the issue has been reconciled then the provisional bail of the petitioner will be confirmed. (Dinesh Kumar Singh, J) Anil/- U T
