JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Tajpur (Halai O.P.) P.S. Case No. 99 of 2018 registered for the offences punishable under Sections 341, 323, 324, 326, 307, 504/34 and Section 302 IPC was subsequently added and Section 27 of the Arms Act.
As per FIR it is alleged that some accused persons have taken son of the informant and killed him. Petitioner is not named in the FIR and later on his name transpired on the basis of recovery of one mobile phone from the vehicle. Submission of learned counsel for the petitioner is that he is not named in the FIR and except his mobile was found there is nothing against him and other co-accused persons have been granted bail by this Court.

Patna High Court CR. MISC. No.48712 of 2019(4) dt.16-11-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if he surrenders and prays for regular bail, the same shall be considered on the basis of the materials available on the record as well as on the submission made above and, if possible, to be disposed of on the same day. This application is, accordingly, dismissed.
