In this case, the petitioner is apprehending his arrest in connection with Rahui P.S. Case No. 67 of 2013 registered for offences under sections 341, 342, 436, 307, 34 of the Indian Penal Code in which later on Section 302 of the I.P.C. was added.
In the present case, an allegation has been made that the present petitioner and Kanchan Devi closed the house, after pouring kerosene oil on body of the deceased, they put on fire and after closing the door, they fled away. The other villagers came there, doused the fire and she was carried to the Hospital. In course of her treatment, she died. Learned counsel for the petitioner submits that in
Patna High Court Cr.Misc. No.36783 of 2018(2) dt.29-06-2018 2/2 the postmortem report, 95% of the body of the deceased was found burnt and she could not give any statement or any restatement before the police. This fact will be seen at the time of trial but, primafacie, it appears that the allegation made against the petitioner cannot be considered to be a fabricated one.
Looking to the entire facts and circumstances of the case and the nature of offence alleged against the petitioner, this Court is not inclined to grant privilege of anticipatory bail. Accordingly, the prayer for anticipatory bail to the petitioner, above named, is rejected.
