NILU AGRAWAL ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Sasaram (Model) P.S. Case No.1300 of 2015 for the offences alleged under Sections 420, 467, 468, 471 and 120(B) of the I.P.C. The prosecution case, in short, as alleged by the Inspector of Police, is that pursuant to the order of the Hon'ble High Court, Patna in C.W.J.C. No.15459/14 for verification of newly appointed teachers and librarians in between the year 2006 to 2015 conducted by the Vigilance Investigation Bureau, Patna by its Inquiry No.B.S.-08/2015 and in the light of Memo No.2162 dated 22.05.2015 the informant was authorized to verify and enquire into the certificates provided by District Programme
Patna High Court Cr.Misc. No.17556 of 2016 (2) dt.28-04-2016 2/3 Officer, Rohtas, of the newly appointed teachers and the librarians in Rohtas District and in course of which the informant found that the certificates of Bachelor of Library Science and the certificate of B.A. of petitioner, Santosh Ram, Raju Kumar, Gaya Chand Mahto, Rajesh Kumar, Alka Kumari and Bablu Kumar Singh (petitioner )and other co-accused Rima Kumari, Prabhakar Sharma and Chandan Kumar Singh were sent to Dr.Bhim Rao Ambedkar, Bihar University, Muzaffarpur and the University Administration informed that the aforesaid certificates of the B.A. and B.L.I.S. of the aforesaid respective accused persons were not issued by the said University rather they have submitted forged certificates in order to get job.
Learned counsel for the petitioner submitted that the petitioner was appointed after due verification and procedure for selection and is ready to refund the entire amount of salary amounting to Rs.19,441/- taken as Librarian at P.H.H. School, Kargahar as and when it is directed to be deposited by the authorities concerned.
Learned counsel for the Vigilance Investigation Bureau submits that the petitioner has been named in the F.I.R. and his name has surfaced after enquiry.
Be that as it may, taking the aforesaid undertaking
Patna High Court Cr.Misc. No.17556 of 2016 (2) dt.28-04-2016 3/3 of the petitioner into consideration, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Rohtas at Sasaram, in Sasaram (Model) P.S.Case No.1300/15 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
