The petitioner apprehends his arrest in connection with Chapra Town P.S. Case no. 618 of 2018, registered under Sections 413 and 414/34 of the Indian Penal Code. The accusation is that on receiving the secret information about presence of two miscreants with theft motorcycles near the clinic of Dr. Renu Kashyap, the informant along with other Police personnel reached there. On seeing the Police personnel, two persons started fleeing boarding on the Apache motorcycle, but on chase, both persons were apprehended with the motorcycle, who disclosed their names as Munna Singh @ Ranjeet Singh and Anku @ Rohit Kumar Singh. The apprehended persons did not produce any paper

Patna High Court CR. MISC. No.47579 of 2019(2) dt.31-07-2019 2/2 regarding ownership of the vehicle. Munna Singh further disclosed the name of five persons, including the petitioner, who indulged in theft of motorcycle.

Learned counsel for the petitioner submits that petitioner was not apprehended on the spot and his name had come in the confessional statement of Munna Singh, who is said to be apprehended by the Police along with the stolen motorcycle on the spot. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 618 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
