The petitioner has filed the instant application for grant of regular bail in connection with Purushottampur P.S. Case No. 54 of 2022 registered under sections 376 of the Indian Penal Code and Sections 4 and 8 of POCSO Act. Allegation against the petitioner is of having sexual relationship with the informant on the pretext of solemnization of marriage with her.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. It is further submitted that the petitioner and victim are belongs same

No.50468 of 2022(3) dt.19-01-2023 2/2 community and the victim made sexual relationship on the pretext of solemnization of marriage with her own consent but when the petitioner retracted from solemnization of marriage, this false case has been lodged against him. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. The petitioner in languishing in judicial custody since 27.6.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Purushottampur P.S. Case No. 54 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VIIth, cum Special Judge POCSO, Bettiah, West Champaran.
