The petitioner is in custody since 10.02.2018 in connection with S.T. No. 384 of 2018 arising out of Kahalgaon P.S. Case NO. 68 of 2018 for the offence registered under Sections 395 and 397 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the first information report but his name has transpired on the basis of the confessional statement made before the police by one co-accused Ramesh Kumar, which has no evidentiary value.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the
