ANJANA PRAKASH ORAL JUDGMENT Date: 25-04-2016 The Petitioners seek quashing of the order of cognizance dated 14.05.2010 passed by the Sub-divisional Judicial Magistrate, Patna City, Patna in Complaint Case No. 143 of 2010.

The case of the Complainant is that she was married to Kumar Pankaj Mani on 06.02.2006 but she was always tortured and was not allowed to meet her husband and was also pressurized to sign some forged documents. It has been submitted on behalf of the Petitioners that no doubt their son was married to Complainant on 06.02.2006 who was working as Senior Accountant and when he was found missing on 08.06.2007 a Complaint was lodged.

Patna High Court Cr.Misc. No.4348 of 2011 dt.25-04-2016 All kinds of efforts were made to seek him out but till date the Petitioners who are parents have not been able to do so. The present Complaint has been filed with the reason that somehow the Petitioners be compelled to give the Complainant what she demands, whether they are reasonable or not.

Considering the background facts of the case, the proceeding including the order of cognizance dated 14.05.2010 passed by the Sub-divisional Judicial Magistrate, Patna City, Patna in Complaint Case No. 143 of 2010 is, hereby, set aside so far as the Petitioners are concerned. The Application stands allowed.
