The petitioner is in judicial custody in connection with Nathnagar (Madhusudanpur) P.S. Case No. 139 of 2021 instituted under Sections 147, 149, 341, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Specific allegation against Dharma Yadav is that he opened fire from the country made pistol which hit the back of the informant. So far as the allegation against other accused persons including the petitioner herein is that they were variously armed with pistol and rod but no role have been attributed to any of them.

Taking into account the aforesaid facts, let the petitioner be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.60794 of 2021(2) dt.20-04-2022 2/2 Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No.139 of 2021. Subject to following conditions: (i) he shall visit the local police station every fortnight for next six months and or the completion of the trial, whichever is earlier to mark his presence;

(ii) he shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.

(iii) the petitioner shall desist from committing any criminal offence again, failing which the State shall take steps for cancellation of his bail bonds.

With the aforesaid observations, the bail application is allowed.
