Five petitioners, out of 14 named in the FIR vide Nowkothi P.S. Case No. 61 of 2015, instituted under sections 326, 307 and 379 IPC and section 27 of the Arms Act, have sought anticipatory bail. The FIR alleges that these petitioners who were assigned specific weapons along with other arrived at the place of occurrence and looted the house. When the protest was made, it is alleged that they used the weapons and caused injuries on several parts of the body of at least three injureds including Pankaj Mishra. In the concluding part specific allegation of assault to Pankaj Mishra has been attributed to petitioner nos. 2,

Patna High Court Cr.Misc. No.12622 of 2016 (2) dt.05-04-2016 2/2 4 & 5. The injury reports of the accused persons are enclosed with the bail application and was also noticed by the learned Sessions Judge in the impugned order. Some of the injuries are simple in nature, whereas some are grievous caused by gunshot and other weapons.

The counsel for the informant has submitted that even the accused persons having lessor allegation had to approached this Court for grant of regular bail which was granted vide order dated 29.09.2015 passed in Cr. Misc. No. 44130 of 2015. Considering the allegations levelled against the petitioners and the material reflected from the record including the impugned order, this Court is not inclined to extended the privilege of anticipatory bail. Prayer is rejected. The petitioners may surrender and seek regular bail. (Kishore Kumar Mandal, J) HR/- U T
