JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Complaint Case No.3110C of 2014 for the offence instituted under Section 420 of the Indian Penal Code. The prosecution case, in brief, is that the complainant Maziya Devi filed complaint on 18.10.2014 alleging therein that after the death of her father Singheswar Mehta, the complainant inherited landed property upon which the accused petitioner Kapildeo Mehta had bad eyes and he tried to purchase the land. It has further been alleged that accused petitioner induced the complainant to get Indira Awas allotted without cost and on this allurement the complainant came at Sub Registry Officer Forbesganj on 13.9.2014 with the accused petitioner by taking the

Patna High Court Cr.Misc. No.15528 of 2016 (2) dt.03-05-2016 2/2 deed writer in his collusion prepared sale deed, procured photograph and took thumb impression of the complainant dishonestly.

It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The matter relates to sale and purchase of the property. The alleged date of occurrence is 13.9.2014 when the sale deed (Annexure-2) was executed in favour of the petitioner and after a period of one month, the present complaint case was filed on 18.10.2014. the matter relates to civil dispute.

On behalf of the State, it is submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Court No.1, Araria, in connection with Complaint Case No.3110C of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
