====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 364A/34 of the Indian Penal Code.

Fifteen unknown persons kidnapped to the son of the informant for demand of ransom. On the very next day, the boy returned. However, he did not name the petitioners which would be evident from the impugned order. Only material against the petitioners is confessional statement of co-accused Prem Chandera Chaudhary. The petitioners are in custody since 23.11.2017. Investigation of the case is already complete. Considering the aforesaid fact, let the petitioners,

Patna High Court Cr.Misc. No.37552 of 2018 (2) dt.05-07-2018 2/2 above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chutiya Police Station Case No. 59 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
