By the impugned order dated 03.02.2016 learned Subordinate Judge-I, Birpur, Supaul, only directed to mark the documents filed by the plaintiff-respondent in Title Suit No.101 of 2001 as exhibits.
The only grievance of the petitioner is that the documents have been marked as exhibits at belated stage. In my opinion, only on the ground of delay the evidence of a party cannot be shut down. The Court has the jurisdiction to receive evidences if the evidences are relevant for just decision of the controversies between the parties. By the impugned order only evidences have been received, therefore, it neither caused prejudice to the petitioner nor it occasioned failure of justice so as to call for
Patna High Court CWJC No.5818 of 2016 (2) dt.27-04-2016 interference in supervisory jurisdiction.
Thus, this writ application is dismissed.
