This application for anticipatory bail arises out of Maner P.S. Case No. 492 of 2018, disclosing offences under Sections 341, 323, 307, 379, 504 and 506 of the Indian Penal Code, including Section 27 of the Arms Act.
The informant is the wife of Sanoj Kumar, whereas co-accused Anirudh Rai is the brother of the said Sanoj Kumar. Apparently thus, the informant is own sister-in-law (Bhabhi) of the co-accused Anirudh Rai. The petitioner is a friend of Anirudh Rai, who is said to have opened fire on the informant's husband and assaulted him variously.
Learned counsel, appearing on behalf of the petitioner, has submitted that that the said Anirudh Rai has been
Patna High Court CR. MISC. No.47641 of 2019(2) dt.31-07-2019 2/2 allowed anticipatory bail by the learned Sessions Judge-I, Danapur.
Considering the above, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of Smt. Nutan Kumari, Judicial Magistrate, 1st Class, Danapur in connection with Maner P.S. Case No. 492 of 2018, subject to the condition as laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
