Petitioners are apprehending their arrest in a complaint case filed with accusation under Sections 420, 467, 468, 120B of the I.P.C.
It is alleged that land of the complainant has been transferred by petitioner Bimla Devi through registered sale deed executed in favour of the petitioner Gita Devi.
Patna High Court Cr.Misc. No.12791 of 2015 (2) dt.26-03-2015 2/2 Petitioner Bimla Devi claimed the land to have purchased from Sitaram Yadav in the year 2001 when Sitaram Yadav died in the year 2002. The complainant claims part of the land in question as his ancestral land and part of it acquired through gift.
It is submitted by learned counsel for the petitioners that vendor of the petitioner Bimla Devi died in the year 2002 after execution of the sale deed in the year 2001 and the sale deed of the petitioners have not been cancelled till date.
Considering the nature of accusation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Complaint Case No. 130 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
