Petitioner, already in custody, seeks bail in connection with Aurangabad Town PS Case No.102 of 2018 registered under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153(A), 295(A), 379 and 120(B) of the Indian Penal Code.

Allegation is that large number of persons including the petitioner belonging to both communities indulged in communal riot.

Submission is that there is general and omnibus allegation against the petitioner, nothing is specific and similarly situated other co-accused persons have been admitted to bail by

Patna High Court Cr.Misc. No.35296 of 2018(2) dt.20-06-2018 2/2 this Court as well as by other co-ordinate Benches of this Court and except five cases of the same day relating to communal riot, the petitioner has no other criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Abdullah Raja is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Aurangabad Town PS Case No.102 of 2018.
