JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Mairwa P.S. Case No. 34 of 2014 registered under Sections-302, 420, 498(A) & other minor sections of the Indian Penal Code. The petitioner No. 1 is father whereas; petitioner Nos. 2, 3 & 4 are full brothers and the petitioner No. 5 is mother of the deceased and so far as the petitioner No. 6 is concerned; she is the wife of petitioner No. 2.
Admittedly, the deceased died on 16-02-2012 and
Patna High Court Cr.Misc. No.12607 of 2015 (2) dt.21-05-2015 2/2 the present case was lodged in the year, 2014 when the informant came to know that the amount of LIC was withdrawn. Moreover, after death of husband of the informant, the family members took a decision to get the marriage of the informant solemnized with the petitioner No. 4 but later on, the informant refused to solemnize her marriage with petitioner No. 4 and lodged this case with an intent to grab the property of her husband. Considering the facts and circumstances of the case as well as submission of the parties, let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Mairwa P.S. Case No. 34 of 2014 to the satisfaction of Learned Chief Judicial Magistrate, Siwan subject to conditions as laid down u/S 438(2) of the Code of Criminal Procedure.
