The petitioners apprehend their arrest in Mofassil P.S. Case No. 214 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.

The informant alleged that his wife went outside of his house to attend the call of nature, but after sometime the informant heard sound of firing and went there. The informant found his wife lying in pool of blood. The informant suspected that the petitioners and others might have killed his wife as they had threatened the deceased on the allegation that she had practiced witch craft on the family members of the petitioners and others.

Patna High Court Cr.Misc. No.51920 of 2014 (4) dt.08-05-2015 2/2 Learned counsel for the petitioners submits that except suspicion there is no tangible material to show the involvement of the petitioner in the alleged murder. Similarly situated co-accused Chandrabali Mistry has already been enlarged on anticipatory bail vide orders passed in Cr. Misc. No. 2073/2015. Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Mofassil P.S. Case No. 214 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
