Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioner seeks anticipatory bail in connection with Ahiyapur P.S. Case No. 527 of 2021, registered for the offences under Sections 420, 406/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was simply employed by co-accused Rahul Jha as an agent and his duty was only to collect the money from the customer and hand over the same to the said Rahul Jha and except this there is no allegation against him. On the basis of suspicion he has been made accused and as per the FIR the main responsibility with regard to the deposit of alleged amount was of Rahul Jha and not of this petitioner.

Learned APP has opposed the prayer of bail and submitted that the petitioner is named in the FIR and he was

Patna High Court CR. MISC. No.60994 of 2021(2) dt.08-06-2022 2/2 involved in the conspiracy with main accused Rahul Jha. Heard both the sides and perused this case. The main allegation is concerned misappropriation of Rs. 99,60,000/-. As per the FIR the main duty to deposit the alleged amount was of coaccused Rahul Jha and the petitioner was simply employed by him as an agent to help in the collecting of alleged money from the customers and moreover as per the paragraph no.3 of bail petition this petitioner has got no criminal antecedent and any specific allegation has not been mentioned against him. Considering the aforesaid facts, this application for anticipatory bail is allowed.

Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 527 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
