1. Heard learned counsel for the petitioners and learned A.P.P. for the State, Mr. Rabindra Kumar.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 96 and 3(5) of the BNS, 2023.
3. The SHO, Garkha P.S. and the Investigating Officer of the case, in compliance of the order dated 01.09.2025, are present in the Court.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.51873 of 2025(3) dt.08-09-2025 2/3 petitioners are persons with clean antecedent and petitioner nos. 1, 3 and 5 are women and allegation is of kidnapping minor daughter of the informant aged about 17 years by Pankaj for the purposes of marriage.
5. Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that Pankaj along with other accused persons kidnapped her minor daughter for the purposes of marriage. It is submitted that no doubt in the FIR, it is alleged that victim is a minor aged about 17 years, but then no certificate in support of the same was produced by the informant. It is next submitted that victim is a major and she eloped with Pankaj, as she was in love.

The SHO, Garkha P.S. and the Investigating Officer of the case, who are present in the Court, submits that during the course of investigation, it transpired that Pankaj is son of aunt (Bua) of the victim and they were known to each other since they are related and they had eloped. It is further submitted that the victim even talked to her cousin brother. It is next submitted that during the course of investigation, the involvement of the petitioner in the occurrence has not surfaced.
7. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.51873 of 2025(3) dt.08-09-2025 3/3 anticipatory bail of the petitioners.
8. Considering the submissions made by the learned counsel for the petitioners and the Investigating Officer of the case, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Garkha P.S. Case No. 71 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
9. The personal appearance of the SHO, Garkha Police Station and the Investigating Officer of the case is dispensed with.
10. Accordingly, the instant anticipatory bail application is allowed.
